Notice is hereby given that noxious weeds and vegetation as defined by Section 38-100 to Section 38-106, Division 4, Article II, Chapter 38 of the City of Hastings Code of Ordinances, as amended, not cut during the growing season may be cut by the City of Hastings or its designated representative, and the owner of the property shall be charged with the cost thereof.
Noxious weeds and grasses more than eight (8) inches in height, dead bushes, and bushes infested with dangerous insects and infectious diseases must be cut and removed from the property. Any owner who refuses to destroy and remove such material may be subject to a Civil Infraction and fine, and the City or its designated representative may enter upon the land as many times as necessary, and destroy and remove such material and charge the cost to the property owner.
Any expense incurred by the City shall be reimbursed by the owner of the land. Unrecovered costs shall be levied as a lien on the property and shall be collected against the property in the same manner as general taxes.
The City, through its Code Compliance Officer, shall have the right to enter upon such lands for the purpose of cutting down, destroying, or removing noxious weeds or vegetation and shall not be liable in any action of trespass.
